I’m not a lawyer, but it looks like no punitive damages will go to cardholders in the Hannaford data breach case. More than 20 law suits were consolidated into one and filed in federal court. The judge threw all of them out except one. Those parties that were reimbursed for losses were excluded from the case.

The Hannaford Brothers chain discovered a breach in February of last year but waited over a month to disclose the information. They were found to be compliant with Payment Card Industry (PCI) Data Security Standards (DSS) but yet the PCI coalition continues to state publicly that, “No PCI compliant entity has ever been breached. That doesn’t work for me. Someone is wrong.
